# TERMS OF SALE FOR READY PIECES (DROPS) Version 1.0. These terms govern the purchase of ready-made products (*drops*) offered by Studio 3$Y. Matters not regulated here are governed by the 3$Y Terms of Service. --- ### § 1. SUBJECT OF SALE 1. The subject of sale is ready-made, one-of-a-kind products (*drops*) made by Studio 3$Y and offered in limited quantities. The description, size, condition and price of a product are given in the 3$Y Terminal or in e-mail correspondence. 2. Ready pieces may be built on bases made by other brands; the trademark disclaimer contained in the Terms of Service applies. 3. Custom products (personalised to individual order) are not covered by these terms — they are governed by the Custom Order Terms (Made-to-Order). --- ### § 2. ORDER AND PAYMENT 1. An order for a ready piece is placed through the form in the 3$Y Terminal or by e-mail. The studio confirms the availability of the product and the terms of the order in its reply. 2. Prices are given with the products; the price confirmed by the studio on the day the order is placed applies. 3. Dispatch requires payment of the full price together with shipping costs, after the studio confirms the order. --- ### § 3. RIGHT TO WITHDRAW FROM THE AGREEMENT (RETURNS) 1. **Right of return within 14 days:** the Ordering Party who is a consumer has the right to withdraw from the agreement without giving a reason within 14 days of taking possession of the product. 2. A clear statement of withdrawal — e.g. an e-mail to `reclamation@3sy.pl` — sent before the deadline is sufficient. A *Model Withdrawal Form* is attached to the order confirmation and may be used, but it is not obligatory. 3. The product must be sent back no later than 14 days from the day the statement is made. The direct cost of returning the product is borne by the Ordering Party. 4. The refund — including the cost of the cheapest standard delivery — is made within 14 days of receiving the statement, using the same payment method the Ordering Party used. The studio may withhold the refund until it receives the product or proof that it has been sent back. 5. The product should be returned unused and unchanged, beyond what was necessary to establish its nature, characteristics and functioning. --- ### § 4. COMPLAINTS (NON-CONFORMITY WITH THE AGREEMENT) 1. The studio is liable for any non-conformity of the product with the agreement on statutory terms (2 years from delivery of the product). 2. Complaints should be sent to the e-mail address: `reclamation@3sy.pl`. 3. The studio responds to a complaint within **14 days** of receiving it. 4. The provisions of these terms do not limit the statutory rights of the Ordering Party who is a consumer. --- ### § 5. DELIVERY 1. Ready pieces are dispatched within **3–5 business days** of payment for the order. 2. Delivery within the European Union; outside the EU on agreed terms. Customs and taxes outside the EU are paid by the buyer. 3. The tracking number is sent to the e-mail address. 4. The risk of accidental loss or damage to the parcel passes to the Ordering Party at the moment it is handed to the Ordering Party who is a consumer, and in the case of an Ordering Party who is not a consumer — at the moment the parcel is handed to the carrier. If the parcel is damaged, it is recommended to draw up a damage report in the courier's presence and to make contact within **48 hours**. --- ### § 6. CARE AND RIGHTS TO MATERIALS 1. The product must be used and cared for in accordance with the *Care Guide* provided, appropriate for the technique and material; the guide constitutes an annex to the agreement. 2. Damage resulting from failure to follow the guide does not constitute a product defect. 3. The design of the product and the photographs taken by the studio constitute the intellectual property of Studio 3$Y. Backstage and production-process footage is excluded from separate consents and remains the non-exclusive property of Studio 3$Y, unless an agreement between the parties provides otherwise (e.g. for B2B collaboration). --- ### § 7. FINAL PROVISIONS 1. Matters not regulated by these terms are governed by the 3$Y Terms of Service. 2. These terms and any agreements concluded under them are governed by Polish law. 3. The provisions of these terms do not limit the statutory rights of the Ordering Party who is a consumer, in particular those arising from the Consumer Rights Act and the Civil Code. In case of conflict, generally applicable law prevails. 4. For an order, the version of these terms in force on the day it was placed applies. 5.
